This Indenture made the second day of April in the sixth year of the reign of our Sovereign Lord George by the Grace of God of Great Britain Hanover and Ireland, King Defender of the Faith and in the year of our Lord God One Thousand seven hundred and Twenty Between the Honourable Thomas Medlycott of the City of Dublin in the Kingdom of Ireland Esquire one of the Commissioners of His Majesties Revenue of the One Part and John Pratt of the said City Esquire of the other part Witnesseth that the Said Thomas Medlycott as well for and in consideration of the Rents Reservations Covenants Conditions and Agreements for Planting and Improvements herein after mentioned as also for and in consideration of the sum of two thousand four hundred pounds to him the said Thomas Medlycott paid by the said John Pratt before enfoaling and delivery of these presents the receipt whereof he the said Thomas Medlycott doth hereby acknowledge and thereof doth aquitt and discharge the said John Pratt his Heirs Executors and Administrators hath bargained sold released and confirmed and by these presents doth Bargain Sell Release and Confirm unto the said John Pratt in his actual possession now being by virtue of a Bargain and Sale to him thereof made by the said Thomas Medlycott for the consideration of five shillings sterling by Indenture bearing date the day next before the day of the date of these Presents and by force of the Statute for Enforcing Dues into Possession and to his Administrators and Assigns All that and those the Town lands Endowments and Hereditaments hereinafter mentioned (that is to say) all that and those The Manor Lordship or reputed Manor and Lordship of Borrishoole in the County of Mayo with all the Under Denominations thereof and thereunto belonging and being parts parcels and members thereof to the said Manor belonging as of and all the fisheries to the same appertaining as fully as now and hereafter they belong to the said Thomas Medlycott and all other Rights Members and Appurtances to the said Manor belonging as fully as the said premises are anyway granted or are legally belonging unto the said Thomas Medlycott and all Rents and Duties payable thereout by virtue of any sale or demise of the premises excepting always and reserving out of this bargain unto the said Thomas Medlycott his Executors Assigns All Timber Trees and Coppices whatsoever Sapplin of Ash, Alder, Oak and Elm which now are or hereafter shall be planted or growing standing lying or being in and upon the said bargained Premises or any part thereof with all Advowsons Presentations of Churches Escheats Felons and Fugitives goods waifes strayes doodands Hawkes Eyries of Hawks and all other Royalties Franchises Privileges Liberties and Immunities whatsoever to the said Premises or any part thereof belonging or appertaining or which now are or hereafter shall be had or found upon the said bargained premises or any part thereof with Ingress Egress and Regress for him the said Thomas Medlycott his heirs and assigns of entering into and taking having digging selling carrying away and doing respectively all and singular the premises before mentioned and excepted together with full liberties not only for the said Thomas Medlycott his Heirs and Assigns but also for the Right Honourable Charles now Earl of Arran in the Kingdom of Ireland and Baron Weston in Great Britain and the Heirs Male of his Body and for default of such issue for James late Duke of Ormond and the Heirs Males of his body with his their and every of their servants and attendants for the time being along with him them or any of them of Hawking Hunting Fishing and Fowling in and upon the Premises in fitt and proper Seasons and plans for the same to have and to hold all and singular the said premises hereby bargained or mentioned or intended to be bargained with their and every of their Appurtances (Except before Excepted) from the twenty fifth day of March now last past unto him the said John Pratt his Heirs and Assigns to the only use and behoof of him the said John Pratt his Heirs and Assigns for ever yielding and paying therefore and thereout unto the said Thomas Medlycott and his Heirs at the Tholsell of Dublin for the first seven years of this Bargain to Compute and be Computed from the twenty fifth day of March now last past the yearly rent or sum of five hundred pounds sterling of lawfull British money together with one fatt Beefe as Anates or two pounds sterling in lieu thereof at the Election of the said Thomas Medlycott and his heirs together with six pence per pound for every pound of the said rent and Rates as Receivers Sallary and also from and after the said term of seven years yielding and paying unto the said Thomas Medlycott and his Heirs yearly and every year for ever after the said several terms of seven years and seventy one years the yearly rent of two thousand and ten pounds of like lawfull money of Great Britain together with one fatt beefe as Anates or two pounds sterling in lieu thereof at the Election of the said Thomas Medlycott and his heirs and also yielding and paying unto the said Thomas Medlycott and his Heirs yearly and every year for ever after the said several terms of seven years and seventy one years to be paid the yearly rent or sum of two thousand and ten pounds of like lawfull money of Great Britain together with one fatt Beefe as Arrates or two pounds sterling in lieu thereof at the Election of said Thomas Medlycott and his Heirs to be paid to the said Thomas Medlycott His Heirs and Assigns by two even moyetys and equal portions at the two usual feasts or days of payment in the year (That is to say) on the Feast of St. Michael the Archangel and the Feast of the Annunciation of the Blessed Virgin Mary free and clear off and from and without deduction or abatement for any Taxes Assessments Subsidies or Impositions ordinary or extraordinary by Act of Parliament or otherwise or other matter or thing whatsoever except the fee farm rent to the Earl of Arran out of the premises

the first payment thereof to be made on the Feast of St. Michael the Archangel now next ensuing and the said John Pratt for himself and his heirs doth hereby grant all and singular the several and respective Rents Duties Annates and Sallaries above mentioned respectively to be reserved and every of them to the said Thomas Medlycott and his heirs and assigns for ever to be paid and payable at such times portions and in such manner as above mentioned for payment and performance thereof and to be had held enjoyed and received to the said Thomas Medlycott and his heirs for ever as aforesaid and the said John Pratt for himself his Heirs Executors Administrators and Assigns doth hereby covenant promise and agree to and with the said Thomas Medlycott his heirs and assigns by these presents that the said John Pratt his Heirs Executors Administrators and Assigns shall and will from time to time and at all times for ever hereafter well and truly satisfy and pay or cause to be satisfied or paid the said several and respective rents Annates Duties Receivers Sallaries and Sums of Money respectively as aforesaid when and as often as the same shall become and grow due and payable on such days and times and in such manner and form as herein mentioned for payment thereof and likewise pay bear and discharge over and above the respective rents and sums of money as aforesaid all such Taxes Subsidies Contributions Assignments and Public Charges which now are or hereafter shall be charged or imposed on the premises or the Hork thereof or any part thereof by Act of Parliament or otherwise howsoever Except the rent payable to the Earl of Arran as aforesaid

and in case it shall happen that the said respective rents or reservations services or duties or any part of them should be behind unpaid or unperformed at or by the space of forty one days over or after any of the times on which the same ought to paid or performed as aforesaid that then it shall and may be lawfull to and for the said Thomas Medlycott his heirs and assigns into the said premises and every part thereof to enter and Distrain and the Distress and Distresses then and there found to take load drive and carry away and the same to sell and dispose of in such manner as by law is provided touching distress as for rent between landlord and tenant and whenever and as often as all or any of the rents duties or services hereby referred or agreed to be paid or performed as aforesaid shall be behind or unpaid or unperformed at the times hereby appointed for payment or performance thereof respectively and for fifty days next after such respective times that then it shall and may be lawfull to and for the said Thomas Medlycott his heirs and assigns into the said above Bargained premises or any part thereof in the name of the whole to reenter and the same to have hold and enjoy as in his and their first and foremost Estate and then also this present bargain and sale to be void at the election of the said Thomas Medlycott his heirs and assigns. This present Indenture or anything herein contained to the contrary notwithstanding and the said John Pratt for himself his Heirs and Assigns doth covenant and grant to and with the said Thomas Medlycott his Heirs and Assigns by these presents that he the said John Pratt his heirs and assigns and his tenants living and dwelling on the premises shall and will from time to time and all times forever hereafter appear and do suit and service at the courts Leet and Courts Baron of the said Thomas Medlycott his heirs or of the said Earl of Arran to be held for the manor of Borrishool aforesaid when and as often as duly summoned thereto and that he the said John Pratt his heirs executors administrators and assigns and their respective undertenants shall for ever hereafter grind all their corn at the Manor Mill of Borrishool aforesaid provided always and this bargain is upon this condition that neither the said John Pratt nor his heirs executors administrators or assigns shall alien the premise or any part thereof without the special signature of the said Thomas Medlycott his heirs and assigns first had and obtained in writing provided always and this bargain is upon this further condition that the said John Pratt his heirs executors administrators and assigns shall within thirteen years after the commencement of this Bargain divide or cause to be divided all the arable pasture and good land of the said Manor and premises into forty or fifty separate proper farms and different holdings in such manner and according as they have been surveyed and laid out by one John Russell surveyor or as they shall be otherwise divided by the said Thomas Medlycott and his heirs and to ditch and quicksett the same allotting a proper viable part of the mountain course and Bogg lands to each of the said farms or holdings with different and proper marks to bound and maintain the same and that the said John Pratt his heirs executors administrators and assigns shall also at his and their proper costs and charges ascertain by good and sufficient marks and boundaries sett and distinguish the just bounds of said Manor and all and singular the said premises and subdivisions so to be made and set out as aforesaid and keep the different and apart from all other lands and grounds and shall also at his and their own proper costs and charges in law defend support and maintain the said Bounds and all the just rights of him the said Thomas Medlycott of and in to the same premises of in and in to the fisheries and all other the profits emoluments and appurtances whatsoever to the said Thomas Medlycott and to the said Manor and premises of right belonging to the said Thomas Medlycott upon notice and request furnishing the said John Pratt upon such oration and tryall (if any shall ensue) with such writings evidences monuments patents and Receipts as he the said Thomas Medlycott now hath covering the same or which he can anyways come by without suit in law

and the said John Pratt doth further covenant for himself his Heirs Executors Administrators and Assigns to and with the said Thomas Medlycott his heirs and assigns that he the said John Pratt his heirs executors Administrators and Assigns shall also within the first thirteen years of this bargain erect and build or cause to be erected or built near Ballyvaughan Bridge on each side of the river or elsewhere is some convenient place or places on the premises twenty new houses for tenants with proper lofts over the same to be built of stone and mortar of lime and sand and the roofs thereof to be slated and shall also to each house respectively found in and double quicksett one acre of land in an English husbandlike manner for gardens and shall plant or cause to be planted in them respectively good fruit trees and which shall be duly preserved and constantly upon decay of any of them so supplied with new fruit trees for ever

and also shall on each farm so to be subdivided and laid out as aforesaid every year for ever plant or cause to be planted the certain number of trees of Ash Oak or Elm as by Act of Parliament for that purpose as is directed in this Kingdom and also shall in each and every year sett two thousand willows and sallies in the boggs or other proper places within the said Manor or in default thereof shall within the first thirteen years of this Bargain lay out the sum of five hundred pounds in other proper improvements upon the premises so in lieu of those severall last mentioned at the Election of the said John Pratt his Executors or Assigns all which several plantations or other improvements in lieu thereof should be duly preserved cherished and supplyed in the case of any delay in the best manner and as this Statute directs and requires and the said John Pratt his Executors and Assigns shall and will well and sufficiently keep the said premises and all the houses Edifices Buildings Woods Lodges Coppices Quicklotts and other Improvements and plantations which now are or hereafter shall be made on the hereby bargained premises for ever in good and sufficient repair and the Trees Woods and Plantations shall Preserve Cherish and Maintain and on Decay shall replenish the same and that neither he the said John Pratt or his Executors Administrators or Assigns shall cropp cut down or carry away off or from the bargained premises any manner of Wood Timber Trees or coppiced wood without the privity or syroure of the said Thomas Medlycott his Heirs or Assigns first had and obtained And the said Thomas Medlycott for himself his Heirs and Assigns doth by these presents covenant promise and agree to and with the said John Pratt his Executors Administrators and Assigns that he the said John Pratt his Executors, Administrators and Assigns paying the respective yearly Rents and reservations here referred in manner and form aforesaid and observing performing and fulfilling and keeping all and singular the covenants Grants Articles Clauses Conditions and Agreements before in these presents mentioned and contained on his and their and every of their parts and behalf to be observed performed or fulfilled and kept shall and may from time to Time and at all times hereafter lawfully, peaceably and quietly have hold occupy possess and enjoy all and singular the said premises hereby bargained and intended to be bargained without any lawfull sett suit trouble Domicil Eviction Entry Mollestation or Interuption whatsoever of him the said Thomas Medlycott his heirs and assigns or of any person or persons whatsoever lawfully claiming by from or under him them or any of them (one Lease of the premises made or granted by the Earl of Arran to Sir Henry Bingham Bart. Lately sorsafed for thirty one years and whereof seven years are yet to come and unexpired from Lady Day last only excepted and for a period In Witnesseth whereof the parties to these presents have hereunto interchangeably sett their hands and seales the day and year first above Written
